Here's the bottom line;

"Thanks to the efforts Friends of the Falls supporters across the state and beyond, the State of North Carolina now has official ownership of the 2200 acre tract containing High Falls, Triple Falls, and Bridal Veil Falls.

The Council of State voted unanimously to invoke eminent domain on the tract yesterday at a special meeting. Legal papers, including a $12.5 million bond, were filed at the Transylvania and Henderson County courthouses very early this morning. These papers formalize State ownership."

What happens next? According to one who knows, the most probable scenario to follow is;

"The State will file a law suit against the owners of the the property and deposit $12.5 Million with the Clerk of Court's office (the State's estimate of the value of the lands). Eventually, if there is no settlement with the owners, there will be a jury trial to determine the fair market value of the property.
The State takes immediate ownership of the land, but there will be some time before the trial starts."

So, as of today, the state of North Carolina OWNS the property. Though there may yet be judicial wrangling over land value & fair market compensation, and it could be a lengthy time period before resolution, it is no longer privately owned & it certainly opens the door for possible inclusion in the Gathering 2001 itinerary.
